2. Purpose and Scope
This Notice governs access to and use of gonomae.com, app.gonomae.com, and the routes, portals, forms, and digital services associated with Nōmae that refer to this document, including, as applicable, the Guest Atlas and the hotel and supplier portals.
Nōmae develops a Journey Intelligence platform geared toward boutique hotels and the guest experience. Depending on the contracted configuration and deployment status, the service may include pre-arrival features, personalization, recommendations for experiences and itineraries, Mission Boards, operational communications, contextual assistance, hotel services, connections with suppliers, reservations, regional information, analytics, and management tools for professional users.
Access to certain areas may be subject to an invitation, a personal link, credentials, permissions granted by a hotel or supplier, or a prior contractual relationship.
3. Terms of Access and Use
The user agrees to use the Sites and their content diligently, lawfully, and in accordance with this Notice, the applicable specific terms, and current regulations.
The following uses, among others, are prohibited:
accessing or attempting to access accounts, systems, data, or restricted areas without authorization;
interfering with the operation, availability, integrity, or security of the Sites;
introducing malware, malicious code, or automation tools intended to abuse the service;
using content, data, or features for unlawful or fraudulent purposes, or in a manner that infringes on the rights of third parties;
to engage in mass extraction, scraping, systematic copying, or reuse of databases, inventories, or content, unless expressly authorized or permitted by mandatory law;
impersonate another person, hotel, supplier, or professional user;
using another person’s links, tokens, invitations, or personal credentials without authorization.
Nōmae may limit or suspend access when there are reasonable grounds to suspect fraud, abuse, a security risk, a breach of contract, or use contrary to these terms.
4. Information, Recommendations, and Artificial Intelligence
Nōmae may use deterministic rules, verified data, user-provided signals, stay context, recommendation systems, and artificial intelligence models to organize information, generate Journey proposals, prioritize experiences, create Mission Boards, and produce summaries, explanations, translations, or contextual assistance. The recommendations and content generated are intended to provide support, organization, and personalization. They do not in and of themselves constitute a guarantee of availability, safety, suitability, quality, price, schedule, access, or the outcome of a third-party experience or service.
When a decision requires operational confirmation—for example, regarding availability, reservations, schedules, capacity, certification, access conditions, or the provision of a service—the confirmation from the relevant hotel, provider, or third party shall prevail.
5. Hotels, Providers, and Third Parties
Nōmae functions as a technological and operational layer that connects guests with hotels, experience providers, and other service providers.
Each hotel retains its own responsibilities regarding its establishment, services, guests, legal obligations, and contractual relationship. Experience providers are responsible for the effective provision of their services, their availability, staff, permits, certifications, safety, operating conditions, and any legal obligations that apply to them.
The inclusion of a hotel, provider, experience, service, or third-party content within Nōmae does not imply that Nōmae assumes the obligations of that third party, except where Nōmae has expressly assumed such an obligation in a contract or specific term. Where applicable, the specific terms and conditions regarding a reservation, cancellation, refund, modification, no-show, or service provided by a third party will be displayed in the corresponding booking flow or will be governed by the provider’s applicable terms and conditions.
6. Reservations, Booking Fee, and Payments
Nōmae is developing a model in which, for certain third-party experiences, Nōmae may charge its own booking fee and the provider may charge the guest directly for the balance corresponding to its service. When this model is active, the interface must provide information—prior to confirming the transaction—regarding the amounts, items, applicable terms, and, where applicable, who charges each part of the price.
The existence of a payment infrastructure should not be interpreted as a guarantee that Nōmae acts as an organizer, travel agency, direct provider of the experience, or custodian of third-party funds. The legal classification of certain activities, particularly in Indonesia/Bali, is subject to regulatory and contractual validation prior to full deployment.
Until these validations are completed, Nōmae may limit, modify, or disable certain payment flows, markets, payment methods, fees, or features.
7. Service Availability and Changes
Nōmae works to keep the Sites available and up-to-date, but does not guarantee uninterrupted availability, complete freedom from errors, compatibility with all devices, or the indefinite continuation of any specific feature. Interruptions may occur due to maintenance, updates, or issues with infrastructure providers, telecommunications, maps, messaging, artificial intelligence, payments, PMS, flight data, or other third-party services. Nōmae may modify, replace, suspend, or remove features when necessary for technical, operational, commercial, legal, security, or product-related reasons, while complying with any applicable contractual obligations.
8. Destination and Travel Information
Nōmae may display information about destinations, experiences, weather, transportation, flights, events, practical requirements, schedules, or other travel-related conditions. Certain information may come from public sources, authorities, hotels, suppliers, or external integrations and may change on short notice. When an issue has legal, immigration, health, safety, or regulatory implications, the user must refer to the official source or the instructions of the competent authority. Nōmae is not a substitute for medical, legal, immigration, tax, or safety advice, nor for official instructions.
9. Intellectual and Industrial Property
Unless otherwise indicated, the rights to the Nōmae trademark, visual identity, interface design, software, code, texts, structures, methodologies, classification systems, Journey Intelligence architecture, Atlas, Mission Boards, databases, inventories, documentation, photographs, graphics, illustrations, and other proprietary content belong to Nōmae or are used with the authorization of their respective owners. Access to the Sites does not grant the user any ownership rights to these elements. Their reproduction, distribution, modification, public communication, commercial exploitation, systematic extraction, reuse, or creation of derivative works without authorization is prohibited, except as permitted by applicable law. Trademarks, content, photographs, maps, logos, and other third-party materials belong to their respective owners.
10. External Links and Services
The Sites may contain links, integrations, or access to services managed by third parties, such as hotels, experience providers, payment systems, maps, messaging services, email, PMS, Wallet, flight information, social media, or analytics services.
Nōmae does not generally control the policies, availability, security, or content of external sites. Access to them is subject to their own terms and policies. The inclusion of a link does not necessarily imply a recommendation, sponsorship, or control over the third party, unless expressly stated.
11. Liability
Nōmae shall be liable for the obligations legally incumbent upon it and for those it has expressly assumed in its contracts or specific terms and conditions.
To the extent permitted by applicable law, Nōmae shall not be liable for damages arising exclusively from:
decisions made in disregard of visible notices, restrictions, or operational confirmations;
outdated or incorrect information provided by third parties when Nōmae could not reasonably have detected it;
cancellations, changes, delays, breaches, or damages attributable to hotels, suppliers, or other third parties;
temporary unavailability due to infrastructure, telecommunications, or external services beyond Nōmae’s reasonable control;
improper, fraudulent, or unauthorized use of accounts, links, or credentials by the user;
force majeure or events beyond Nōmae’s reasonable control.
Nothing in this Notice limits or excludes any liability that cannot be legally excluded, nor does it limit the mandatory rights to which consumers or users are entitled where applicable.
12. Protection of Personal Data
The processing of personal data is governed by the Nōmae Privacy Policy, which applies to the Sites and services specified therein.
In general, Nōmae may act as the data controller for its own purposes and as a data processor when processing guest data on behalf of a hotel. Experience providers may act as data controllers with respect to the processing necessary to provide their own services. For privacy-related questions, please contact legal@gonomae.com.
13. Cookies and Similar Technologies
The use of cookies, local storage, pixels, identifiers, service workers, and similar technologies is governed by the Nōmae Cookie Policy. Non-essential technologies, including analytics or advertising technologies where applicable, must remain subject to the appropriate consent. Users may change their preferences via the permanent “Manage Cookies” link available at the bottom of the Sites.
14. Security and Accounts
Users must maintain the confidentiality of their credentials, personal links, tokens, and access mechanisms. They must report any suspected unauthorized use or security incident related to their account without delay. Nōmae implements technical and organizational measures designed to protect systems and data; however, absolute security against all possible risks cannot be guaranteed.
15. Electronic Communications
Nōmae or the hotels may use email, WhatsApp, or other enabled channels to send invitations, access information, reminders, pre-arrival information, operational changes, support, or communications related to the stay or service. Commercial communications are subject to the applicable legal basis and opt-out or unsubscribe mechanisms. Unsubscribing from marketing communications does not necessarily imply the cancellation of operational messages necessary to provide a requested stay or service.
16. Minors
Nōmae’s services are not designed for minors to independently manage contractual relationships, payments, or consents that legally require sufficient legal capacity. When a trip includes minors, the necessary data must be processed through the responsible adult and with the appropriate safeguards.
17. Changes to This Notice
Nōmae may update this Legal Notice when its services, legal structure, operating model, suppliers, regulations, or market conditions change.
The version published on the Sites will be the one in effect at any given time. When a change requires specific acceptance or new information from the user, the appropriate mechanism will be provided.
18. Governing Law and Dispute Resolution
This Notice shall be interpreted in accordance with the laws applicable to Nōmae and to the specific relationship with the user.
Where mandatory consumer protection laws or laws of another jurisdiction apply, this Notice does not intend to exclude them or limit the rights they confer. The determination of the contractual jurisdiction, venue, and dispute resolution mechanisms will be finalized in the specific terms and conditions for users, hotels, and suppliers once Nōmae’s definitive contractual and corporate structure is established.
