Please read the following carefully before using Nōmae
Summary
These Terms govern the guest’s access to and use of Nōmae, including the digital experience offered before, during, or after a stay, personalized recommendations, Atlas, Journey, experiences, reservations, and other features that may be available depending on the hotel, destination, and product phase.
Nōmae may act as a technology and personalization layer between guests, hotels, and third-party providers. A recommendation, proposal, or availability displayed on Nōmae does not in and of itself constitute a confirmed reservation nor does it make Nōmae a provider of a third-party experience. When a contract or reservation for an external experience is made, the relevant financial and contractual terms applicable to that transaction will be displayed before confirmation.
1. Owner and Scope
Product Provider: Miguel Angelo Romo Rodríguez, operating under the trade name Nōmae.
Contact: legal@gonomae.com
These Terms apply to guests’ use of gonomae.com, app.gonomae.com, pre-arrival links, PWA, Atlas, Journey, and other guest interfaces linked to the service.
2. Access to Nōmae
Access may be granted via a hotel invitation, personalized link, QR code, credential, account, or any other enabled mechanism. The guest must use the access solely for their own stay or authorized experience and must keep their links, codes, or credentials reasonably secure. Certain features may depend on the hotel, the plan purchased, location, provider availability, product phase, or permissions granted.
3. Roles of Nōmae, the Hotel, and Providers
Nōmae provides technology for personalization, discovery, assistance, organization, and—when enabled—intermediation or technical facilitation of reservations. The hotel remains responsible for the hospitality services it provides directly and for the operational information it provides to the guest. The third-party provider is responsible for the experience, activity, transportation, dining, admission, service, or offering it provides directly, including its operational requirements, safety, availability, licenses, and execution, unless otherwise required by law.
Nōmae’s involvement in a specific reservation will be determined by the information displayed before the transaction is confirmed.
4. Personalization, Journey, and Recommendations
Nōmae may use stated preferences, stay context, availability, usage signals, and reasonable inferences to rank or personalize suggestions. Recommendations are for guidance only. They do not guarantee that an activity is suitable for everyone, available at the time of use, will be offered at a specific price, or will accommodate unstated personal circumstances. Guests must disclose relevant restrictions when an activity requires them to do so and review the provider’s information before booking or participating.
5. Atlas and Contextual Information
Atlas and other assistance features may summarize, translate, explain, or provide context for information about the stay, destination, or experiences. AI-generated information may contain errors or become outdated. When an issue depends on official or changing information—for example, entry requirements, health, safety, transportation, flights, schedules, local regulations, or access conditions—official sources, the hotel, or the relevant provider will take precedence. More information on Política de IA y sistemas automatizados — Nōmae.
6. Third-Party Experiences
Nōmae may display experiences offered by independent providers.
Before booking, the guest must review at least:
the provider’s identity, when applicable;
the description and content of the experience;
date, time, and location;
price and items charged;
requirements, restrictions, or conditions of participation;
cancellation, modification, and no-show policies;
any specific additional conditions.
The inclusion of a provider on Nōmae does not constitute an absolute guarantee of future service nor does it eliminate the provider’s own liability.
7. Reservation and Confirmation
A request is not considered a confirmed reservation until the system, Nōmae, the hotel, or the provider—depending on the applicable process—issues a clear confirmation. Some experiences may require manual validation, subsequent availability, a counterproposal regarding the schedule, or the provider’s acceptance. If the request cannot be confirmed, there is no obligation to provide the experience under the terms initially requested.
8. Price, Booking Fee, and Payments
When Nōmae acts as an intermediary in a third-party reservation, the exact payment flow will be displayed before confirmation. The model may include a booking fee charged by Nōmae, clearly distinguished from the amount due to the provider. In certain booking processes, Nōmae may charge only its own fee, and the provider may bill the guest directly for the remaining balance.
Before payment is made, the following must be clearly disclosed:
the total price known at that time;
the amount charged by Nōmae, if any;
the amount due to the provider, when separate;
currency, applicable taxes, or surcharges;
the relevant cancellation and refund policy.
Nōmae will not hold the supplier’s funds in escrow unless a future payment structure is expressly implemented and regulated as such.
9. Cancellations, Modifications, and Refunds
Cancellation, modification, no-show, and refund policies may vary by provider and experience and must be displayed before the reservation is confirmed. When Nōmae charges its own fee, the treatment of that fee in the event of a cancellation or incident must be clearly indicated separately, where applicable. Nothing in these Terms limits any mandatory rights that may apply to the guest. If a confirmed experience cannot be provided for reasons attributable to the provider, Nōmae may assist in arranging an alternative, cancellation, or refund in accordance with the applicable contract and payment terms.
10. Availability, Changes, and Force Majeure
Schedules, capacity, weather, transportation, local restrictions, closures, operational issues, or force majeure circumstances may affect an experience. Nōmae, the hotel, or the provider may propose reasonable changes when necessary. The guest will be notified when the change is material and there is a functional channel available to do so.
11. Safety and Participation Requirements
The guest is responsible for determining whether they meet the stated requirements for an experience and for following the provider’s safety instructions. When an activity requires a minimum age, physical condition, documentation, insurance, license, equipment, or any other requirement, these must be met.
Nōmae may remove or block an experience or provider when it detects significant risks, insufficient information, or noncompliance, without this implying ongoing supervision of all third-party services.
12. Account, Profile, and Continuity Between Stays
When a persistent account or profile exists, Nōmae may allow certain preferences or settings to be reused between stays in accordance with the applicable legal basis, consent, or settings. The guest may request the rectification or erasure of data and exercise other applicable rights in accordance with Política de privacidad — Nōmae.
13. Communications
Nōmae may send operational communications necessary for the stay, reservation, security, changes, confirmations, or support. Non-essential marketing communications will be handled in accordance with the applicable legal basis and preferences and may be unsubscribed from using the provided mechanisms.
14. Permitted Use
Guests must not use Nōmae to:
accessing other people’s data or accounts;
make fraudulent reservations or impersonate third parties;
interfere with the security or operation of the service;
automate abusive access, scraping, or unauthorized mass extraction;
use content or features for unlawful purposes.
Nōmae may limit or suspend access in cases of fraud, security risks, abuse, or material breach.
15. Privacy, Cookies, and AI
The processing of personal data is described on Política de privacidad — Nōmae. The use of cookies and similar technologies is described on Política de cookies — Nōmae. The use of recommendation systems, inferences, AI, and automation is described on Política de IA y sistemas automatizados — Nōmae.
16. Intellectual Property
Nōmae’s software, design, proprietary content, trademarks, interfaces, methodology, and materials are protected by applicable rights.
The guest is granted only a limited right of access and personal use of the service during the authorized period or relationship.
Content from hotels or suppliers may belong to their respective owners.
17. Liability
Nōmae shall be liable for its own obligations in accordance with the law and the role it assumes in each transaction. Unless otherwise required by mandatory law, Nōmae is not liable for acts, omissions, operational security, quality, delays, or breaches attributable exclusively to hotels, suppliers, carriers, or other independent third parties. Nōmae also does not guarantee that AI recommendations or personalization will be perfect, nor that all third-party information will remain permanently up to date.
Nothing in these Terms excludes or limits rights or liabilities that cannot be legally excluded.
18. Support and Complaints
For issues related to Nōmae: legal@gonomae.com. When a complaint concerns the provision of a third-party experience, Nōmae may facilitate contact or coordination with the relevant provider, without prejudice to Nōmae’s own obligations in that specific situation.
19. Changes to the Terms
These Terms and Conditions may be updated due to legal, technical, commercial, or product-related changes. Substantial changes will apply prospectively. When a modification affects a reservation or contract that has already been made, the terms and conditions in effect at the time of confirmation will apply, unless otherwise agreed upon or required by law.
20. Governing Law and Jurisdiction
The applicable law and jurisdiction will depend on the country from which the contract is entered into, the market in which the service is provided, the nature of the user, and the applicable mandatory consumer and tourism regulations. Prior to the commercial launch in each market, Nōmae must define and publish the corresponding territorial clause. No choice-of-law clause shall deprive a consumer of the mandatory protection to which they are entitled.
